The nationwide outbreak of salmonella linked to peanuts and peanut projects could have been prevented.

JANUARY 29, 2009 – According to the Food and Drug Administration, the Peanut Corporation of America found salmonella in its plant in Blakely, Georgia, but shipped the tainted product anyway. The Peanut Corporation of America found strains of salmonella during twelve tests it conducted in 2007 and 2008 at its Blakely, Georgia, plant. In January of 2009, FDA inspectors visited the plant and found still more salmonella contamination. Federal inspectors reported having found roaches, mold, a leaking roof, and other sanitation issues. (more…)

Eli Lilly and Co pleads guilty to Medicaid fraud claims based on off-label promotion of Zyprexa.

JANUARY 15, 2009 – Eli Lilly and Co, under criminal and civil investigation concerning the drug Zyprexa, has pleaded guilty to violation of federal law and settled Medicaid fraud claims based on off-label promotion of Zyprexa. The drug was approved for the treatment of schizophrenia but was promoted by Eli Lilly for unapproved uses, including dementia—especially in the elderly. Due to the drug’s propensity to cause diabetes, this led to many patients unnecessarily taking Zyprexa and suffering serious physical illnesses, including death. Lopez McHugh’s own Ramon Lopez was one of the lead attorneys who settled the nationwide Zyprexa personal injury suits.

Drywall made in China found to emit harmful chemicals

January 13, 2009 – Knauf Plasterboard is a German-based company and an international supplier of building materials. Recently, drywall made by Knauf Plasterboard Tianjin Co. Ltd. of China has been reported to emit a foul-smelling sulfur compound that blackens and corrodes metals such as chrome, brass and silver. This can affect everything from appliances to silverware to plumbing; more importantly, it can cause a health hazard. Although the problem originated in Florida, complaints have begun appearing in Virginia. Although the drywall is built in China, it is believed that some of Kanfu’s material is marked as being from Mexico, though they do not have any manufacturing in Mexico. Sadly, much of the plasterboard was imported for use in the rebuilding efforts that followed Hurricanes Wilma and Katrina. Further details can be found here.

Litigation over contact lens solution

January 6, 2009 – Attorney Jason Ochs was interviewed by the Lawyers USA publication concerning the ongoing litigation over Complete MoisturePlus contact lens solution manufactured by American Medical Optics, Inc.  More than 150 persons have filed lawsuits based on infections caused by the contact lens solution, and many have suffered partial or complete loss of vision, as well as the need for corneal transplants.  The complete article can be found here.
